The Simões, Ribeiro, Bernardini and Furiati Law Firm (“Simões Ribeiro”) is committed to protecting privacy and safeguarding any data shared with us.

With this in mind, Simões Ribeiro has drawn up this privacy policy (“Privacy Policy”) based on Law No. 13,709, of August 14, 2018 (“General Data Protection Law” or “LGPD””), with the purpose of describing how we treat and protect Personal Data within the scope of the provision of our services, observing the right to privacy, the provisions of the LGPD and good data protection practices.

By sharing your data with us, the Data Subject freely and expressly acknowledges and agrees with this Privacy Policy, which also applies to the processing of Personal Data of collaborators, employees, associates and interns. In this regard, it is worth mentioning that access to our website and the use of its content automatically bind the User to compliance with the rules of conditions of use and information security and privacy policies, as described in this Privacy Policy.

Such collection will occur through different means, with the free, explicit and specific consent of the Holders. For example, the collection of Personal Data may be carried out by: (i) receipt and/or access to documents, physical or digital; (ii) provision by the Holder of Personal Data through meetings, in person or virtual, with partners, associates or employees of Simões Ribeiro; (iii) provision by the Holder of Personal Data through registration on our website; and, further, by (iv) provision by the Holder of Personal Data, for application or hiring by Simões Ribeiro.

Depending on the type of activity and/or interaction with Simões Ribeiro, different Personal Data will be collected to better serve you, for example:

  • When accessing our website to find out our location, group of collaborators, among other information, electronic identification data may be collected during your access;
  • When visiting our office in person, you may be asked for identification, contact and/or professional activity data in order to identify you and carry out the security checks required for access to our facilities;
  • When applying for a position at our office, you may be asked for information relevant to your application and possible hiring, including identification, contact and professional activity data; and
  • When contracting our services, you may be asked for information necessary for the performance of our activities, such as identification, contact, professional activity, financial, family data, among others that may be important for our service.

Simões Ribeiro may also collect Personal Data for the purpose of, for example: (i) the execution of a contract or preliminary procedures related to a contract to which the Data Subject is a party, at his request; (ii) the regular exercise of rights in judicial, administrative or arbitration proceedings; (iii) compliance with the requirements of law or regulation; (iv) your legitimate interest and considering the use of publicly available information; in addition to other purposes permitted by the LGPD.

It should be noted that, in the context of our legal services, Simões Ribeiro may use Personal Data to provide legal content to clients, potential clients and/or third parties, which includes: (i) the dissemination of information about our areas of activity; (ii) production and/or dissemination of news in which Simões Ribeiro or its collaborators participate; (iii) preparation of institutional communications, bulletins, memoranda or invitations in which Simões Ribeiro participates; or (iv) customer satisfaction surveys, always respecting the privacy and reasonableness of the use of the Personal Data of the Holders.

Furthermore, as applicable, Simões Ribeiro may seek specific consent from Data Subjects to collect Personal Data, always observing its commitment to protecting them, in accordance with applicable legislation, adopting all necessary measures, within its capacity and responsibility, to prevent the improper use of Personal Data.

Please note that Simões Ribeiro does not process Cookies on its website, however, if it does so, it will update this Privacy Policy to provide for the applicable provisions.

Security and Storage of Personal Data

Simões Ribeiro always seeks to implement the best market practices for the storage and protection of collected Personal Data, adopting technical and administrative security measures to protect stored information from any unauthorized access, accidental or unlawful situation of destruction, loss, alteration, communication or inadequate or unlawful processing of data.

However, considering that there is no totally secure method of electronic transmission or storage, we do not guarantee the absolute security of Personal Data.

Meetings, whether in person or virtual, between Simões Ribeiro and Data Subjects are not recorded, except in cases where expressly authorized by the Data Subject, required by law or to defend the interests of our clients, within the limits of applicable legislation.

Sharing and Transfer of Personal Data

As a general rule, Personal Data collected by Simões Ribeiro is not shared with third parties, except in the cases described below:

  • If necessary for the provision of our services;
  • If necessary for the provision of services by our correspondents, in defense of the interests of our clients;
  • If required to comply with a legal or regulatory obligation, court order or if required by a competent government authority;
  • If requested or authorized by the Owner; and
  • If necessary or convenient for the execution of Simões Ribeiro's organizational activities and purposes, whether based on established contractual partnerships (for example, for outsourcing services for physical document archiving; outsourcing of computer systems for electronic data archiving; outsourcing of services of cloud computing, mailing and media management; outsourcing of payment processing services, financial institution services, administrative services, accounting support and other subcontracting).

It should be noted that Simões Ribeiro is headquartered in Brazil and the data collected here will be governed by national legislation, so that when accessing our website or use our services, the User or Holder of Personal Data agrees to the processing and transfer of data to Brazil and, eventually, to other countries through third-party services (e.g., cloud data storage). The Personal Data of Users of the website and our services, when transferred to other countries, may be subject to local legislation and relevant rules, as applicable.

Access, modification and deletion of Personal Data

As a general rule, Simões Ribeiro will not retain Personal Data after the reasons that justified its Processing have ceased, considering, however, that retention is not required by law, or that the time necessary to preserve the legitimate interest of Simões Ribeiro has elapsed, as the case may be.

It is an exception that, even after the termination of a contract or relationship, some records may remain accessible due to legal requirements or because they are necessary to demonstrate the terms of the relationship with Simões Ribeiro (declaration, exercise or defense of a right in legal proceedings). In such cases, the applicable prescriptive deadlines will be observed and the use of Personal Data will only be for that specific purpose, and, after such deadlines, the data may be deleted or anonymized, as the case may be.

Data Subjects may exercise rights related to their Personal Data at any time, upon request. The following are the rights of Data Subjects, under the terms of article 18 of the LGPD:

  • confirmation of the existence of treatment;
  • access to data;
  • correction of incomplete, inaccurate or outdated data;
  • anonymization, blocking or deletion of unnecessary, excessive data or data processed in non-compliance with the provisions of the LGPD;
  • portability of data to another service or product provider, upon express request, in accordance with the regulations of the national authority, observing commercial and industrial secrets;
  • deletion of Personal Data processed with the consent of the holder, except in the cases provided for in art. 16 of the LGPD;
  • information on public and private entities with which the controller shared data;
  • information about the possibility of not providing consent and the consequences of refusal;
  • revocation of consent, under the terms of § 5 of art. 8 of the LGPD.

In this context, we warn that, in some cases, Simões Ribeiro may not be able to respond to the request due to legal obligation or exercise of rights in processes.

In order to improve our services and always aim to provide the best security and privacy practices, Simões Ribeiro reserves the right to change this Privacy Policy at any time and at its sole discretion, so that any significant change will be duly informed through our website, making the updated version of this Privacy Policy available.

It is important to note that Simões Ribeiro is not responsible for the processing of data on third-party websites that we may provide access to via links. Simões Ribeiro has its own privacy and Personal Data collection procedures, and these processes do not extend to websites that the User may access outside of our platform.
